1. Introduction

These Terms and Conditions (“Terms”) govern access to and use of the StepApp platform located at stepapp.co.za (the “Platform”).

StepApp is owned and managed by Jthoka and Brainergy Marketing Solutions (collectively referred to as “StepApp”, “we”, “us” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.

These Terms are governed by the laws of the Republic of South Africa.

2. Nature of the Platform

StepApp is an information and opportunity aggregation platform that provides updates relating to funding, tenders, training programmes, and business development initiatives.

StepApp:

  • Does not provide financial, legal, investment, or professional advisory services;
  • Does not guarantee funding approval, tender awards, or business success;
  • Does not act as an agent, broker, or intermediary unless expressly stated in writing.

All opportunities published on the Platform are subject to the terms and conditions of the issuing organisations.

3. User Responsibilities

By using the Platform, you agree to:

  • Provide accurate and truthful information when subscribing;
  • Use the Platform only for lawful purposes;
  • Not misuse, interfere with, or attempt to gain unauthorised access to the Platform;
  • Not reproduce, distribute, or exploit content from the Platform without written permission.

You are solely responsible for evaluating any opportunity or third-party offering listed on the Platform.

The Platform and its content are provided on an “as is” and “as available” basis.

StepApp makes no representations or warranties, whether express or implied, including but not limited to:

  • The accuracy, completeness or reliability of information;
  • Continuous or uninterrupted availability of the Platform;
  • The suitability of opportunities for any particular purpose.

While reasonable care is taken to ensure accuracy, StepApp does not warrant that information is error-free or up to date at all times.

5. Limitation of Liability

To the maximum extent permitted by South African law:

StepApp, its owners, directors, partners, employees, contractors and affiliates shall not be liable for any direct, indirect, incidental, consequential, special or punitive damages arising from:

  • Use of or inability to use the Platform;
  • Reliance on information published on the Platform;
  • Engagement with third-party organisations or service providers;
  • Technical interruptions, data loss or security breaches beyond our reasonable control.

Users access and use the Platform at their own risk.

Nothing in these Terms excludes liability where such exclusion would be unlawful under South African legislation, including the Consumer Protection Act.

The Platform may contain links to third-party websites, services or advertisements.

StepApp:

  • Does not control or monitor third-party platforms;
  • Does not endorse or guarantee third-party services or content;
  • Is not responsible or liable for any loss, damage or claim arising from interactions with third parties.

Any engagement with a third party is solely between you and that third party.

7. Intellectual Property

All content on the Platform, including text, branding, logos, graphics and layout, is the property of StepApp or its licensors and is protected by applicable intellectual property laws.

No content may be reproduced, copied, distributed or modified without prior written consent from StepApp.

Unauthorised use may result in legal action.

Personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act.

By using the Platform, you consent to the collection and processing of personal information as outlined in the Privacy Policy.

9. Indemnity

You agree to indemnify and hold harmless StepApp, its owners, affiliates and service providers from and against any claims, losses, damages, liabilities, costs or expenses arising from:

  • Your breach of these Terms;
  • Your misuse of the Platform;
  • Your violation of any law or third-party rights.

10. Suspension and Termination

StepApp reserves the right to:

  • Suspend or terminate access to the Platform at its discretion;
  • Remove content;
  • Restrict access where unlawful or improper use is suspected.

Such action may be taken without prior notice where reasonably necessary.

11. Amendments

StepApp reserves the right to amend these Terms from time to time. Updated Terms will be published on the Platform with a revised effective date.

Continued use of the Platform constitutes acceptance of the amended Terms.

12. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Republic of South Africa.

Any dispute arising from or relating to the use of the Platform shall be subject to the jurisdiction of the competent courts of South Africa.
