The Gauteng Department of Education (GDE) has issued an open tender (GT/GDE/048/2026) inviting qualified law firms to submit proposals for the establishment of a pre-qualified panel of legal service providers. This strategic three-year contract aims to ensure the department has immediate access to specialized legal expertise to address the high volume of incidents occurring at schools, district offices, and head office, thereby strengthening the GDE’s legal support framework and compliance mandate.

The appointed law firms will provide comprehensive legal support across multiple specialized categories on an as-and-when-needed basis. Key service areas include:

  • Category 1: The Law of Delict and Contracts – Handling civil liability matters and contractual disputes.
  • Category 2: Mediation, Alternative Dispute Resolution (ADR), and Labour Law – Prosecuting and/or presiding in high-profile hearings and labour-related matters.
  • Category 3: Drafting, Interpretation & Review of Legislations, Regulations & Policies – Providing expert advisory on legal frameworks and policy development.
  • Category 4: Litigation – Representing the department in court proceedings and legal disputes.
  • Category 5: Legal Investigation – Conducting formal inquiries and investigations as required by the department.

Mandatory Compliance Requirements

To be considered responsive, bidders must submit a comprehensive documentation package demonstrating institutional legitimacy and legal expertise. Essential submissions include:

  • Proof of valid Central Supplier Database (CSD) registration.
  • A current SARS Tax Compliance Status (TCS) PIN.
  • A valid Broad-Based Black Economic Empowerment (B-BBEE) certificate or a valid sworn affidavit attested by a Commissioner of Oaths.
  • Verifiable and contactable reference letters on client letterhead, including contact details of the signatory, indicating previous experience in similar legal projects.
  • Proof of membership in relevant professional legal bodies.
  • Evidence of personnel/attorneys holding at least an NQF Level 7 (Bachelor’s degree or equivalent) or higher qualification.

Functionality Evaluation Criteria

Proposals will undergo a rigorous two-stage evaluation process. Bidders must first pass the functionality assessment, which evaluates company experience, capacity to deliver, and technical methodology across the specific legal categories bid for. A minimum threshold of 70 points is required to qualify for the next stage. The evaluation allocates points based on:

  • Company experience in similar legal service provision.
  • Capacity to deliver, including the qualifications and experience of proposed attorneys.
  • Detailed proposals outlining the scope of work and deliverables for each category.
  • Social responsibility programs with specific reference to activities in the Gauteng Province.
